We cannot predict an accident. By definition, an “accident,” is something that happens suddenly or by chance, and is unanticipated, causing injury. Accidents catch us off guard and unprepared. This makes them even more difficult to deal with. Life is stressful enough without an unexpected injury; life can be difficult enough, even when we know what to plan for and what to expect. An unanticipated event, like an injury-causing accident can completely disrupt our lives, causing turmoil and confusion as to what to do.

What Is Personal Injury?
Simply, a personal injury is the physical or emotional injury caused by someone else.
What Is a Work-Related Injury?
A work-related injury is an injury suffered by an employee while in the scope employment.
What Is Negligence?
A person who was negligent—intentionally or unintentionally—is held responsible for your injuries. Negligence is simply another word for carelessness. If it can be proved the other party involved in the accident did not use reasonable care or did not act as a reasonable person should have, then that person is liable for your injuries because they acted negligently.
What Does Liability Mean?
Liability is having legal responsibility for something. Someone who is liable is responsible for compensating you for your injury.
What Is Financial Compensation?
Financial compensation is the money that is paid by the liable party to the injured party to compensate the injured party for injuries or losses caused by the responsible or liable party.
How Do I Know What My Case Is Worth?
The main factors that determine how much your case is worth are the extent and nature of your physical injury.
If you are the victim of negligent behavior or another wrongdoing, that caused you injury, then you would file a claim against that person. Claims can be filed against individuals, companies, cities, hospitals, schools, and other entities that caused you injury. Filing a claim simply means you are notifying the responsible party of an injury and you are asserting your rights to seek compensation for that injury. Most personal injury claims can be resolved or settled out of court. However, if the claim cannot be resolved out of court, then the claim must be pursued in court, where it would become a lawsuit.
Motor Vehicle Accidents and Other Types of Accidents
The majority of the injuries we see are caused from accidents occurring on the roadways. Whether you are a passenger, a driver or a pedestrian, the road can be an incredibly dangerous place and this is where some of the most tragic, life-altering accidents take place. Tips: Take Notes, Take Pictures, Don’t Talk
Immediately following an accident, if possible, write down as much as you can about the incident. The more you have on record, the better. A helpful process is to go through your senses: what did you see, hear, feel, and smell? Once you are safe and have a moment to think clearly, try to remember as many details as possible. How did the accident happen? Write down what took place leading up to the accident. Who were you with? Where were you going and why were you going there? What time of day was it? What was the weather like? Is there a witness? Write down the name, address and number of any witness. What did you hear others say at the scene of the accident?
If you can, take pictures of as many details as possible of the scene of the accident. Take pictures of yourself also. All of this gathering of information will help you to receive the full amount of financial compensation to which you are entitled.
In the days following your accident, document any changes you notice, such as sleepless nights, anxiety, discomfort or new pains you may experience. Take note of any opportunities, social or work-related, that you have to miss due to your injury. If you cannot work or miss any other commitments, make sure you also document such time lost from work or lost commitments.
And finally, don’t talk. The less you say the better. Anything you say can be used against you later. Accidents are highly emotional incidents and it is very easy to say something you don’t mean or that may be misunderstood, misinterpreted or taken out of context, all to be used to your disadvantage and to lessen the value of your claim. If you are contacted by the other party’s insurance company, understand the insurance representative does not work for you and does not represent you. They are not motivated by your best interest. It is best to have them call your attorney. If you don’t have an attorney working for you and representing your interests, tell the insurance company representative you will hire an attorney and your attorney will then contact them.
